These Terms & Conditions (“Terms”) govern your access to and use of https://www.mokuglasses.com/ (the “Site”) and any purchase of Moku Glasses products (“Products”). By using our Site or placing an order, you agree to these Terms in full.

1. Definitions

   • “Customer,” “you,” “your”: the individual or entity ordering Products.

   • “Order”: purchase request submitted via the Site.

   • “Products”: smart glasses and related accessories sold on the Site.

2. Eligibility
   You must be at least 18 years old and legally capable of entering these Terms.

3. Order Acceptance & Cancellation

   • All Orders are subject to acceptance and availability.

   • We may refuse or cancel any Order—for suspected fraud, inaccuracies, or other business reasons—before shipping.

4. Pricing & Payment

   • Prices are in USD; local currency conversion at checkout for other regions.

   • Payment is due in full at Order time, via supported methods (credit/debit cards, PayPal).

   • We reserve the right to update prices without notice, but changes do not affect accepted Orders.

5. Shipping & Delivery

   • We ship worldwide via DHL, UPS, FedEx, or local carriers.

   • Estimated delivery times are provided at checkout; these are estimates only.

   • Risk of loss passes to you upon our delivery to carrier.

6. No Refunds / All Sales Final
   IMPORTANT: ALL SALES ARE FINAL.

   • We do not accept returns, refunds, or exchanges, except for defective or damaged items as below.

   • Defect Claims: Contact help@mokuglasses.com within 7 days of receipt, include order number and photos. At our discretion, we will replace the item.

7. Warranty Disclaimer

   • Products are covered by a 12-month limited warranty against manufacturing defects.

   • Excludes damage from misuse, modification, or unauthorized repair.

8. Intellectual Property

   • All Site content—text, graphics, logos, images, software—is owned by or licensed to Moku Glasses.

   • You may not use, reproduce, or distribute our IP without express written consent.

9. User Conduct
   You agree not to:

   • Violate any laws or rights of third parties

   • Upload harmful code (viruses, malware)

   • Interfere with Site operation or security

   • Reverse-engineer our Products or software

10. Limitation of Liability
    TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER MOKU GLASSES NOR ITS AFFILIATES SHALL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SITE OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM.

11. Indemnification
    You agree to defend, indemnify, and hold harmless Moku Glasses and its affiliates from any third-party claims arising out of your breach of these Terms or your misuse of Products or the Site.

12. Force Majeure
    Neither party will be liable for delays or failures caused by events beyond reasonable control, including acts of God, war, strikes, or supplier issues.

13. Governing Law & Dispute Resolution

    • These Terms are governed by the laws of Japan, without regard to conflict-of-law principles.

    • Disputes shall be resolved exclusively in Tokyo courts.

14. Severability & Waiver

    • If any provision is invalid or unenforceable, the remainder stays in effect.

    • Our failure to enforce any right is not a waiver.

15. Entire Agreement
    These Terms, together with our Privacy Policy and any Order confirmations, constitute the entire agreement and supersede prior communications.

16. Changes to Terms
    We may revise these Terms at any time. The “Last Updated” date will reflect changes. Continued Site use after changes signifies your acceptance.
